Objections seen online to the CSA Survivors Peoples Tribunal: We can take it Pioneers that we are

Objection your honour!
The proposed CSA Survivors Peoples Tribunal is now being plonked in front of a Court with a Stream of Witnesses to tell us where and how we are going wrong. We welcome them all.

The once respected criminal barrister John Cooper***, who was an unsuccessful Labour Parliamentary candidate, and President of the League Against Cruel Sports which successfully lobbied for the Hunting Act, and still advises them on prosecutions against fox-hunting, has apparently agreed to ‘chair the People’s Tribunal’ – the Tribunal is said to have been set up as a result of ‘conversations between John Cooper and a Joanne Welch. Joanne Welch is a lady who comes on-line at 7.30am, and is still tweeting at approximately one minute intervals (I kid you not!) 9 hours later. 13,965 Tweets to date. She spends her time retweeting anything which shows a sceptical attitude towards Government transparency.

‘The People’s Tribunal’ is said to be a huge improvement on the ‘secretive and less than transparent’ Government Inquiry which will – allegedly – be hobbled by its terms of reference.

They are encouraging ‘survivors of sexual abuse’ to come forward and ‘tell their stories’. Who to?

Well, so far, they have declined to say who will be funding them, they have declined to say who is on the committee, they have declined to show even other ‘survivors’ who is behind the organisation, unless they were at the secret squirrel inaugural meeting on August 4th – apparently there were people there who ‘didn’t want to be identified’. ‘Evidence’ is to be collected by Skype, so that if the Government inquiry ‘lacks bite or is too narrow’ the ‘People’s Tribunal’ can ‘act’. How is not explained.

In the meantime, those with tales of sexual abuse by powerful politicians are invited via Twitter to tell their stories to an organisation comprised of ‘we know not who’ – besides a failed would be Labour Politician – financed by ‘we know not who’, which discusses and has aims of ‘we know not what’. Transparency eat your heart out.

It would be laughable if sexual abuse wasn’t such a serious subject – primarily ruining the lives of those subjected to it, but also ruining the lives of those prematurely or falsely accused of it.

The very idea sounds like a remake of “Witchfinder General”…quite horrifying…mob hysteria is capable of anything, online as well as off.

The downside to all this is that in a not to distance future children who come forward
with very legitimate claims of child abuse will be be dismissed by the now outraged
masses as just another attention seeker.

These self elected white knights soon move onto another cause.

Anna Raccoon seems to be falling into the error of pre-judging a thing before it is even in existence like   CSA Survivors with their understandable to-be-addressed anxieties.. by publishing in error rather than ask questions directly from the Survivors with those involved.

  I know of the  very real preparation that is being put into making this #CSASurvivors #PeoplesTribunal  a rip roaring Success like the Iran Tribunal  which was the first Peoples Tribunal to be a PEOPLES Tribunal. http://www.irantribunal.com/index.php/en/ i Joe Public if you like for the first time  took a commanding role along with  top ranking Legal  Support Team consisting of  Legal Specialists,  leading members of the Judiciary and of course John himself.  It was a cracking Team of  Non Lawyers plus Lawyers that made this Tribunal rock, setting a pattern for other  PT’s of which there have been 80.

   Peoples Tribunals vs Courts

 PT’s are still Courts and Tribunals because they harness the professional talents  of Lawyers who conduct the Tribunal. The same Legal Procedures you witness in Court apply equally to PT’s. It is a relatively new kid on the block when it comes down to Legal Processes where you are required to

1) Gather the Evidence Witnesses CSA Survivors would give Live Evidence

2) Examine and scrutinize the Evidence with a ‘jaundiced eye’ as Kriegler J says in the

Judgement of the Tribunal.

 instead of starting at the Police Station under PACE it is led from my Witnesses who give live Evidence that is scrutinized by experienced qualified  Lawyers who then , once satisfied, are able to compile it into a form that can be submitted to the Police,  where further Evidence can be gathered where because of the strength and integrity of Evidence   Child Abusers can be arrested, submitted to  due process of Law and the Rule of Law with it’s further safegaurds to ensure Fair Trials under Article 6 so they are duly and properly convicted avoiding false allegations that wreck lives as much as Paedophiles being covered up by the authorities

in their seemingly   unlimited capacity for crime creating further trauma for  Survivors.

  It is suitably qualified experienced LAWYERS  (Generalist and or Specialist) that can make or even conversely break a would be Tribunal. Therefore it is also needful that Not  Lawyers learn how to harnass the multi-faceted skills of the Legal Profession, entailing massive responsibilities for both parties.

 Provided both parties know what they are doing and the twain meet in fully paid up lawyers,  proper legal procedure etc then all is well in PT world.

 Therefore I don’t think Raccoons criticisms stand. She just hasn’t gone for the Evidence so to speak.

In conclusion a CSA Peoples Tribunal can be fully supported by both the  CSA Survivors, the general public, Government bodies  and the Legal Proffesion itself because for all it’s infancy it is a  still a viable model that needs to be used to convene to get full justice.




***  From where I am standing John Cooper or JC is fundamentally good man who I have publically defended on a number of occasions ,and am proud to do so. Whatever his faults, we are only human and all have them. I am also convinced about the stuff that needs bringing into his life/all lawyers lives that will make his life so much easier.
