Marrache: abuse of process claim

Lawyers acting separately for the four defendants in the multi-million pound Marrache fraud trial, have made submissions asking for proceedings to be stayed on the grounds that the Royal Gibraltar Police have not disclosed evidence properly. This follows the emergence of some new evidence in the past week, which had not been disclosed by the police.

John Cooper QC told the court that in the circumstances, it could be impossible for his client, Isaac Marrache, to receive a fair trial.  Mr Cooper said the police’s approach to evidence disclosure was highly unreliable and calls for a complete re-analysis

 I AGREE WITH JCQC ON THIS. THIS STRIKES ME AS FAIR. THE JUDGE SHOULD GIVE WAY TO JOHN ON THIS TO HAVE A FAIR TRIAL.

Benjamin Marrache’s lawyer, Dorian Lovell Pank QC, argued there has been no real chain of command in respect of evidence disclosure, which has been carried out on an ad-hoc basis.  He said he lacks confidence in the Crown’s ability to comply with its obigations on disclosure, and therefore feels Benjamin Marrache is unable to secure a fair trial.

Acting for Leanne Turmbull, Anne Cotcher QC, associated herself with Mr Cooper and Mr Lovell Pank’s comments.  For his part, Solomon Marrache’s lawyer, Christopher Finch, said he’s not alleging bad faith on behalf of the RGP, but said the disclosure issue is one of enormous importance.

IS THIS A MULTI-HANDED TRIAL? I think so?

 Leanne Turnbull and Benjamin Marrache Lawyers in agreement with John Cooper QC. I agree with them.

 I don’t think Lead Proscecutors args stand up. He claims the Defence Team are trying to waylay the Trial a fact I would dispute. By sorting out the Police’s Evidence   The Marrache brothers in fact would get a FAIR TRIAL.
